Perto de completar quatro meses com um ministro a menos, o STF já registrou empate em pelo menos 39 votações na Segunda Turma. Destas, 23 eram processos criminais e beneficiaram o réu, e outras 16 causaram a suspensão do julgamento.
Em julho, o ministro Marco Aurélio se aposentou do Supremo e Jair Bolsonaro indicou André Mendonça para ocupar a cadeira. A corte estava de recesso naquele mês. Mais de cem dias depois, um tempo de espera recorde, a sabatina de Mendonça ainda não foi marcada na Comissão de Constituição e Justiça do Senado, por decisão do senador Davi Alcolumbre.
Os 39 empates aconteceram na Segunda Turma do tribunal. Em vez dos habituais cinco integrantes, o colegiado conta com apenas quatro: Gilmar Mendes, Ricardo Lewandowski, Nunes Marques e Edson Fachin. Cármen Lúcia integrava esse grupo, mas passou à Primeira Turma com a saída de Marco Aurélio.
Além da Segunda Turma, os empates no Supremo também podem acontecer no plenário: os julgamentos têm chance de terminar em cinco a cinco, contando com o presidente da corte. Colegiados públicos, como tribunais e parlamentos, geralmente têm um número ímpar de integrantes, justamente para evitar uma indefinição nas votações.
