A Rede Globo foi obrigada a pagar uma indenização de R$ 30 mil e pensão vitalícia de meio salário mínimo para Kelly da Silva Claudino, figurante que se acidentou nas gravações da novela “América”, em 2005. Segundo informações do site da Jovem Pan, o valor ainda é acrescido de juros de 1% ao mês desde o acidente.
Kelly caiu de uma arquibancada durante as gravações da novela, “fato que lhe causou diversas fraturas e trauma na região lombar com compressão medular”.
Segundo a figurante, a Globo arcou com o tratamento médico por dois anos, até 2007, mas cancelou seu plano de saúde antes que ela tivesse se recuperado totalmente do acidente.
A Globo tentou usar fotos de redes sociais de Kelly para alegar que ela não estaria com a capacidade reduzida para exercer a função de figurante.
No entanto, o laudo pericial mostrou o contrário, apontando que Kelly “teve crises de pânico, bem como ficou um ano totalmente incapaz, além do que restou permanentemente incapaz, ainda que parcialmente”; e, “possui uma cicatriz na região dorsal esquerda, passando pela lombar e flanco esquerdos, com seis centímetros na região espondileia ao nível lombar, com hipertonia muscular paravertebral à direita, ainda apresentando dores a apalpação”.
