O ex-prefeito paulista e ex- candidato à Presidência derrotado, Fernando Haddad (PT), foi condenado pelo Tribunal de Justiça de São Paulo a pagar R$ 200 mil reais de indenização ao promotor Marcelo Milani. A decisão ainda cabe recurso.
Milani, que é promotor do Ministério Público de São Paulo (MP-SP), processou Haddad após ser acusado por ele de ter pedido R$ 1 milhão de propina para não mover uma ação civil pública sobre a construção do estádio do Corinthians. O processo detalha que a declaração de Haddad foi feita em entrevista a uma revista em 2017.
A acusação de corrupção foi investigada pelo Tribunal de Justiça de São Paulo (TJ-SP) e pela Corregedoria do MP. O ex-prefeito não entregou provas.
Em nota, a defesa do petista afirmou que ele ainda não foi intimado, mas entrará com recurso.
O juiz Fabio Fresca, da 4ª Vara Cível, entendeu que os fatos são “infundados” e até “criminosos”.
“Não há dúvidas de que o comportamento do requerido teve o condão de caracterizar dano moral, pois, impôs ao autor passar por situações vexatórias e delicadas, nos âmbitos profissional, familiar e social, tendo que enfrentar o descrédito da sociedade e de seus pares diante da séria acusação de corrupção passiva e prevaricação”, escreveu.
De acordo com a assessoria de Haddad, “enquanto Prefeito de São Paulo, [a atuação dele] se restringiu a comunicar supostas irregularidades às autoridades cabíveis, sob pena de ser conivente com a situação”.
“A oitiva de testemunhas que presenciaram os fatos e que podem auxiliar no esclarecimento da verdade, como o ministro Alexandre Moraes e o desembargador Roberto Porto, foi negada pelo juiz, embora expressamente solicitada em mais de uma ocasião pela defesa”, diz nota.
