O ex-presidente Lula recebeu na segunda-feira (16), do senador Lindbergh Farias (PT-RJ), um parecer jurídico afirmando que ele poderá disputar as eleições presidenciais em 2018 ainda que condenado em segunda instância -e ainda que o STJ (Superior Tribunal de Justiça) e o STF (Supremo Tribunal Federal) não concedam liminar para suspender a inelegibilidade que viria com essa sentença.
De acordo coma Folha de S. Paulo, o parecer foi assinado pelo professor Luiz Fernando Casagrande Pereira, do Paraná. Ele diz que mesmo nessa situação limite, o PT poderá registrar a candidatura de Lula no TSE (Tribunal Superior Eleitoral) em agosto. Só então ela seria objeto de impugnação.
“Ocorre que entre a impugnação e o afastamento de Lula da campanha há uma enorme distância”, diz ele. Se todos os prazos para o julgamento forem cumpridos no TSE, o eventual afastamento só ocorreria em 12 de setembro. Neste intervalo de um mês, Lula já estaria em plena campanha.
