Ministros do Tribunal Superior Eleitoral (TSE) indicam que as informações analisadas até então no inquérito que investiga o abuso de poder cometido pela chapa da ex-presidente Dilma Rousseff e do presidente Michel Temer, nas eleições presidenciais de 2014, não tornariam a petista inelegível. No entanto, o mandato de Temer continua em risco.
Isto porque a condenação no caso de comprovação do caixa 2 seria a cassação dos mandatos dos candidatos eleitos. Como Dilma já foi cassada, só restaria agora aplicar a pena a Temer. Por isso a insistência da defesa do peemedebista de separar as contas da campanha, o que, por histórico, não é prática do TSE.
Conforme explica a jornalista Mônica Bergamo na Folha de S. Paulo, a condenação de inegibilidade só poderia ser dada à ex-presidente se for comprovado que ela sabia da prática do caixa 2, mas isso não foi confirmado por nenhum delator até agora.
Contudo, esta linha de pensamento que o relator do processo, o ministro Herman Benjamin, indica que deve seguir não é aprovada unanimamente no TSE.
