Uma mensagem enviada a um grupo do WhatsApp foi a forma escolhida por uma empresa para demitir uma funcionária. O ato custará, à SOS Medical Produtos Hospitalares, R$ 10 mil de indenização por danos morais, conforme sentença proferida pela Justiça do Trabalho do Distrito Federal.
Conforme denúncia da ex-funcionária, que trabalhou na SOS Medical por dois anos, um dos sócios da empresa foi o responsável pela demissão via aplicativo de mensagem.
Juíza em exercício na 19ª Vara do Trabalho de Brasília, Maria Socorro de Souza Lobo declarou que a forma da dispensa da instrumentadora cirúrgica é “despida do respeito que deve nortear as relações de emprego, posto que nenhum empregador é obrigado a permanecer com um empregado e para tanto deve proceder à rescisão contratual de forma urbana e civilizada, haja vista a inexistência de justa causa”.
A juíza chamou a atenção ainda ao fato de a funcionária ter sido submetida a vexame e “constrangimentos erante seus colegas”. A instrumentadora cirúrgica também pleiteou, no processo, direitos trabalhistas, como adicional de insalubridade, acúmulo de funções, horas extras por falta de intervalos intrajornada e equiparação salarial, como elencou o UOL.
A juíza concedeu, no entanto, apenas o pagamento de horas extras, por falta de concessão de intervalos intrajornada, e da multa prevista no artigo 477 da Consolidação das Leis do Trabalho (CLT), por falta de comprovação da quitação, dentro do prazo legal, da rescisão contratual.
Edson da Silva Santos, advogado da empresa, entrou com recurso. A alegação é de que a conversa do WhatsApp não pode ser usada como prova, pois poderia ter sido adulterada “por qualquer pessoa”. Santos informou ainda que, após a demissão, a ex-funcionária teria feito um acordo com a empresa.
