Um dos autores do pedido de impeachment de Dilma Rousseff, o jurista Miguel Reale Júnior avalia que a publicação de conteúdo proibido por parte de Jair Bolsonaro, na terça-feira (5), poderia custar o cargo ao presidente da República.
Reale argumenta que, de acordo com a lei 1.079 de 1950, é crime contra a probidade na administração “proceder de modo incompatível com a dignidade, a honra e o decoro do cargo”. Ou seja, Bolsonaro teria quebrado o decoro por ter postado o vídeo em suas redes sociais.
“O que destaco é a absoluta desnecessidade de enviar este vídeo adjeto ao povo brasileiro para denunciar algo que tenha sido visto, previamente, por centenas de pessoas”, o jurista explicou ao jornal o Globo.
“Com a divulgação, ele deu exposição a um fato restrito, sem nenhuma necessidade: ou seja, ampliou o ato. Algo que seria visto por algumas pessoas foi visto pelo Brasil inteiro”, complementou.
