Justiça obriga ANM a leiloar minério ilegal extraído da TI Yanomami
Recursos devem ser revertidos para garantir proteção dos indígenas
Decisão da Justiça Federal obriga a Agência Nacional de Mineração (ANM) a realizar o leilão da cassiterita extraída ilegalmente da Terra Indígena Yanomami, em Roraima. A medida, concedida nesta segunda-feira (30), atende um pedido do Ministério Público Federal (MPF) e tem como objetivo reverter o valor arrecadado para ações para garantir a segurança do território e de combate ao garimpo ilegal na região.
A Justiça determinou que todo o trâmite para a promoção do leilão seja finalizado até 28 de fevereiro. Além do prazo improrrogável, a decisão também fixou multa no valor da R$ 100 mil ao mês, em caso de descumprimento da sentença. Em julho do ano passado, uma outra liminar da Justiça Federal já determinava à realização do leilão, com previsão do repasse integral do mineral apreendido para o custeio de ações contra o garimpo ilegal, incluindo a retirada dos invasores da área. Tais ações deveriam ser planejadas e apresentadas em 90 dias, incluindo o plano de aplicação dos recursos.
Apesar disso, a medida nunca chegou a ser cumprida e o MPF fez uma nova manifestação. Para o órgão, a agência emprega entraves burocráticos como ferramenta para paralisar a eficácia da decisão liminar e demonstra descaso tanto com os povos indígenas quanto com o patrimônio público.
A agência deve informar, em até 5 dias úteis, os dados dos agentes públicos responsáveis pela organização do leilão, sob pena de multa de R$ 1 mil por dia de atraso no fornecimento dos dados indicados.

Em junho de 2022, o MPF ajuizou ação com pedido de tutela provisória depois que a ANM não se manifestou a respeito das solicitações prévias sobre a destinação aos povos indígenas dos bens extraídos da área que ocupam. Os pedidos estavam em recomendação do órgão ministerial, feita no mês anterior, após saber que a agência já preparava edital para desfazimento do mineral e de outras substâncias apreendidas e pretendia receber os valores levantados com a venda.
Para o MPF, a reversão dos recursos do leilão em benefício da própria agência “seria uma grave inversão de ônus dos crimes ocorridos nas terras indígenas, uma vez que cabe ao governo impedir que o garimpo ilegal acontecesse, não podendo assim acabar sendo beneficiado pela prática ilegal”. O material apreendido tem valor estimado em R$ 25 milhões.
